Controller means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

Recipient means a natural or legal person, public authority, agency or another body, to which the personal data are disclosed, whether a third party or not. However, public authorities that may receive personal data as part of a particular enquiry in accordance with Union or Member State law are not regarded as recipients.

A third party is a natural or legal person, public authority, agency, or other body other than the data subject, the controller, the processor, and the persons who, under the direct authority of the controller or processor, are authorized to process personal data.
k) Consent
Consent is any freely given, specific, informed, and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.
2. Data subjects’ rights
Pursuant to Article 15 of the new European General Data Protection Regulation, data subjects have the right to obtain from the controller, free of charge, confirmation as to whether relevant personal data are being processed.
If they are, the data subject shall have a right to know the purpose of the processing, the categories of personal data processed, recipients or categories of recipients to whom the personal data have been disclosed, and the intended duration for which personal data are stored.
Data subjects also have the right to have their personal data corrected or deleted, and to restrict or object to the processing of their personal data.

Collection of general data and information
Sport Driving GmbH’s website collects a series of general data and information whenever it is opened by a data subject or automated system. This general data and information is stored in the server’s log files. The following data may be collected: (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system arrived at our website (referrer), (4) the pages that are accessed via an accessing system on our website, (5) the date and time the website is accessed, (6) an Internet protocol address (IP address), (7) the Internet service provider of the accessing system and (8) other similar data and information that serve to avert danger in the event of attacks on our information technology systems.
This general data and information referred to above are not used by Sport Driving GmbH to identify data subjects. Rather, this information is needed (1) to deliver the content of our website correctly, (2) to improve the content of our website and the way it is advertised, (3) to ensure the long-term functionality of our information technology systems and the technology of our website, and (4) to provide law enforcement authorities with the information necessary for prosecution in the event of a cyberattack. DThese anonymously collected data and information are therefore evaluated by our company, firstly for statistical purposes, and secondly with the aim of improving the level of data protection and data security within our company and ultimately optimising the level of protection we provide for the personal data we process. The anonymous data in the server log files are stored separately from any personal data the data subject provides.
4. Contact via the website
As per the statutory provisions, Sport Driving GmbH’s website provides details of how you can use electronic means of communication to contact our company quickly and communicate with us directly; these options include a general email address. If a data subject contacts the controller by email or via a contact form, the personal data he or she transmits are automatically stored. This kind of personal data transmitted voluntarily by a data subject to the controller are stored for the purpose of processing or contacting the data subject. These personal data will not be transferred to third parties.
4.1 Routine erasure and blocking of personal data
The controller only processes and stores the data subject’s personal data for the length of time necessary to achieve the purpose of storage, or in so far as provided for by the European legislator or another legislator in legislative acts or regulations to which the controller is subject.
If the purpose of storage no longer applies or if a storage deadline imposed by the European legislator or another competent legislator expires, the personal data are routinely blocked or erased in accordance with the statutory provisions.
4.2 Rights of the data subject
a) Right to confirmation
Every data subject has the right granted by the European legislator to obtain from the controller confirmation as to whether or not personal data concerning them are being processed. If a data subject wishes to exercise this right of confirmation, he or she may, at any time, contact our Data Protection Officer or another of the controller’s employees.
b) Right of access
Every data subject shall have the right granted by the European legislator to obtain at any time from the controller, free of charge, information about and a copy of any stored personal data relating to him or her. The European legislator has furthermore stipulated that the following information must be provided to the data subject:
The data subject also has the right to be informed if personal data are transferred to a third country or to an international organisation. If such data transfers take place, the data subject is also entitled to information on appropriate guarantees in this regard.
If a data subject wishes to exercise this right of access, he or she may contact our Data Protection Officer or another of the controller’s employees at any time.
c) Right to rectification
Every data subject shall have the right granted by the European legislator to have any incorrect personal data relating to them corrected immediately. Taking into account the purposes of the processing, the data subject also has the right to have incomplete personal data completed, including by means of providing a supplementary statement.
If a data subject wishes to exercise this right of rectification, he or she may contact our Data Protection Officer or another of the controller’s employees at any time.
d) Right to erasure (right to be forgotten)
Any person affected by the processing of personal data has the right granted by European directives and regulations to request that the controller delete personal data concerning them without delay, provided that one of the following reasons applies and insofar as the processing is not necessary:
If any of the above grounds apply and a data subject wishes to request the erasure of personal data stored by our company, he or she can contact our Data Protection Officer or one of the controller’s other employees at any time. Our company’s Data Protection Officer or another employee will ensure that the request for deletion is complied with immediately.
If our company’s personal data have been made public and our company, as controller, is obliged to erase the personal data pursuant to Article 17 (1) GDPR, our company shall take reasonable steps, including technical measures, taking into account the available technology and the cost of implementation, to inform other controllers that process the published personal data that the data subject has asked these other controllers to erase any links to these personal data and copies or replications of these personal data, unless the processing is necessary. Our company’s Data Protection Officer or another employee will arrange the necessary action in each case.
e) Right to restriction of processing
Any person affected by the processing of personal data has the right, granted by European directives and regulations, to request that the controller restrict processing if one of the following conditions is met:
If any of the above grounds apply and a data subject wishes to request the restriction of personal data stored by our company, he or she can contact our Data Protection Officer or one of the controller’s other employees at any time. Our company’s Data Protection Officer or another employee will arrange for processing to be restricted.
f) Right to data portability
Every data subject shall have the right granted by the European legislator to receive the personal data concerning him or her, which have been provided by the data subject to a controller, in a structured, commonly used and machine-readable format. He or she also has the right to transmit such data to another controller without hindrance from the controller to whom the personal data have been given, provided that the processing is based on consent pursuant to Article 6 (1) (a) or Article 9 (2) (a) GDPR, or on a contract pursuant to Article 6 (1) (b) GDPR, and the processing is carried out by automated means, unless the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
Furthermore, when exercising the right to data portability pursuant to Article 20 (1) GDPR, the data subject has the right to insist that the personal data be transferred directly from one controller to another controller where technically feasible, and provided this does not adversely affect the rights and freedoms of other individuals.
The data subject may at any time contact the Data Protection Officer appointed by our company or another employee, in order to assert their right to data portability.
g) Right to object
Every data subject shall have the right granted by the European legislator to object at any time, on grounds relating to his or her particular situation, to the processing of personal data concerning him or her carried out on the basis of Article 6 (1) (e) or (f) GDPR. This also applies to profiling based on those provisions.
In the event of an objection, our company shall no longer process the personal data, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the assertion, exercise or defence of legal claims.
If our company processes personal data for the purpose of direct marketing, the data subject shall have the right to object at any time to the processing of personal data processed for such marketing. This also includes profiling to the extent that it is related to such direct marketing. If the data subject objects to our company about processing for direct marketing purposes, our company will no longer process the personal data for these purposes.
The data subject also has the right, on grounds relating to his or her particular situation, to object to the processing of personal data concerning him or her which is carried out by our company for scientific or historical research purposes, or for statistical purposes pursuant to Article 89 (1) GDPR, unless such processing is necessary for the performance of a task carried out in the public interest.
The data subject may directly contact our company’s Data Protection Officer or another employee in order to exercise the right to object. The data subject is also free, in connection with the use of information society services, notwithstanding Directive 2002/58/EC, to exercise his or her right to object by means of automated procedures using technical specifications.
h) Automated individual decision-making, including profiling
Every data subject shall have the right granted by the European legislator not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her, unless the decision (1) is necessary for entering into, or the performance of, a contract between the data subject and the controller; (2) is permitted by Union or Member State law to which the controller is subject, and that the law contains suitable measures to safeguard the rights and freedoms and legitimate interests of the data subject; or (3) is made with the explicit consent of the data subject.
If the decision is (1) necessary for entering into, or the performance of, a contract between the data subject and the controller, or (2) made with the data subject’s explicit consent, our company shall take suitable steps to safeguard the data subject’s rights and freedoms and legitimate interests, which include at least the right to have somebody intervene on the part of the controller, to express the data subject’s point of view and to contest the decision.
If the data subject wishes to exercise rights concerning automated decisions, he or she may, at any time, contact our Data Protection Officer or another of the controller’s employees.
i) Right to withdraw consent under data protection law
Every person affected by the processing of personal data has the right, granted by European directives and regulations, to withdraw their consent to the processing of personal data at any time.
5. Data protection for job applications and in the application process
The controller collects and processes the personal data of applicants for the purpose of handling the application procedure. The personal data may also be processed electronically. This is particularly the case if the applicant submits application documents to the controller electronically, for example by email or using a form on the website. If the controller concludes an employment contract with an applicant, the transmitted data will be stored in compliance with the statutory provisions for the purpose of conducting the employment relationship. If the controller does not conclude an employment contract with the applicant, the application documents will be deleted automatically two months after notification of the rejection decision, provided that no other legitimate interests of the controller conflict with deletion. Such legitimate interests include e.g. the obligation to provide evidence in proceedings under the General Equal Treatment Act (Allgemeines Gleichbehandlungsgesetz, AGG).
6. Legal basis for processing
Article 6 (1) (a) GDPR serves our company as the legal basis for processing operations in which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is a party – as is the case, for instance, in processing operations needed for the delivery of goods or the provision of another service or consideration – the processing is based on Article 6 (1) b) GDPR. The same applies to any processing operations necessary to carry out steps prior to entering into a contract, such as when we receive enquiries about our products and services. In the event that our company is required to process personal data on the basis of a legal obligation, such as a tax-related obligation, the processing will be based on Article 6 (1) (c) GDPR In rare cases, the processing of personal data may be necessary to protect the vital interests of the data subject or another natural person. For example, this would be the case if a visitor to our premises suffered an injury and it became necessary as a result to provide his or her name, age, health insurance details or other vital information to a doctor, hospital or other third party. In such cases, the processing would be based on Article 6 (1) (d) GDPR. Finally, data may be processed on the basis of Article 6 (1) (f) GDPR. This legal basis is used for processing operations which are not covered by any of the aforementioned legal grounds, if processing is necessary for the assertion of the legitimate interests of our company or a third party, except if these are outweighed by the interests, fundamental rights or fundamental freedoms of the data subject. We are permitted to carry out such processing operations in particular because they have been specifically mentioned by the European legislator. Recital 47 sentence 2 GDPR states that a legitimate interest may be present if the data subject is a client of the controller, for example.
7. Legitimate interests in processing pursued by the controller or a third party
If the processing of personal data is based on Article 6 (1) (f) GDPR, our legitimate interest is conducting business activities for the benefit of all of our employees and our shareholders.
8. Length of time for which personal data is stored
The length of time for which personal data is stored is decided on the basis of the applicable statutory retention period, such as that defined in the German Fiscal Code. Once this period has expired, the relevant data are routinely erased, provided they are no longer required for the performance or establishment of a contract.
9. Statutory and contractual regulations on the provision of personal data; need for conclusion of a contract; data subject’s obligation to provide personal data; potential consequences of not providing data
In some cases, you may be required to provide personal data on the basis of statutory provisions (e.g. tax regulations) or contractual provisions (e.g. information on the contracting party). A data subject may sometimes need to provide us with personal data which will subsequently be processed by us, if he or she concludes a contract with us. For example, the data subject is obliged to provide us with personal data if our company concludes a contract with him or her. If the data subject does not provide us with personal data, this will mean that a contract cannot be concluded with him or her. The data subject must contact our Data Protection Officer before providing personal data. Our Data Protection Officer will inform the data subject on a case-by-case basis whether the provision of personal data is required by law or by contract, or is necessary for the conclusion of the contract, whether there is an obligation to provide personal data, and what the consequences of not providing personal data would be.

This includes all safety standards and precautions as well as the accurate adjustment to the participants’ level and the features of the selected cars.
Thus, Sport Driving offers every target group the perfect dynamic driving experience. The product – the sports car – is always in the spotlight. We create the opportunity to extract everything we can from the cars and drivers, so that we can extensively test the special features of each model in a controlled environment.
